developing story. we are learning new detail also this morning about the attack on the u.s. consulate in ben ghazi, libya, that killed four americans. among them was this man here. christopher stevens. the u.s. ambassador who was born and raised in northern california. he graduated from uc berkeley in 1982 and then received a law degree from half thine hastings in 1989. he was killed in this attack. secretary of state clinton condemning the attacks. a libyan official says the americans were killed when protesters attacked the consulate in response to a u.s. film they deemed blasphemous to the prophet muhammad. president obama released a statement condemning that attack.

he was once the victim. a south bay priest beaten as he sat in a retirement home. now he's an accused sex offender. his alleged victims are calling for prosecutors to charge him with perjury. the high profile calls of reverend jerold lindner. live from san jose, where today prosecutors will be holding a critical meeting with the man who beat lindner that could lead to charges against that priest. >> reporter: the l.a. wants to hear from lynch before deciding. lynch was acquitted of that beating of father lindner several months ago here in san jose.

now this case is upon us. it was in that trial that father lindner took the stand in the beating. he denied ever molesting william lynch or his brother even though the prosecutor basically admitted it during opening arguments. lynch's lawyer jumped out of his seat and told the judge to get the priest an attorney because he had just perjured himself. harass accused of prosecutor of setting up the police to commit perjury. lynch told nbc bay area he didn't understand why no perjury charges had been filed. >> he purchase jured himself pure and simple. so he will meet today here at the county government center with several people including

lynch and his attorney. so this morning father jerry lindner sleeping in his retirement home not knowing if the d.a. will haul him back into court. now, that jury back in this trial, they aquilted lynch, even though he admitted in court that he did beat up father jerry lindner. we're live in san jose. >> 6:04. breaking the silence. a former student of stillerman prep in san jose says he was sexually abused at that school. saying jesuit brother farrington abused him when he was a boarding student there in the '60s. the california society jess suettes which overseas bellarmine sent a letter to staff that reads, jess suette brother william farrington was removed from ministry with minors after allegations surfaced from another former student. he now exercises no public

ministry and lives under close supervision at the jesuit infirmary. the victim says he wanted to put a story out there as part of the healing process and to encourage other possible victims to seek healing their own. police hoping newly released surveillance photos will help somebody identify the suspects who robbed and killed a 7 eleven store clerk. seconds later, police say they shot and killed the 67-year-old clerk. this marked milpitas' first homicide of the year. it happened two blocks away from the police station. >> it just shows you how brazen and willing these suspects are to take risks to actually commit an armed robbery which eventually led to a homicide right down the street from the police department. >> the owner of that 7 eleven is hiring security for the overnight hours and the parent company is offering a cash

reward for the arrest and conviction of the suspects. >> police have released dramatic surveillance video of an armed robbery at a convenience store. take a look. this happened last tuesday at the shell gas station on second and fourth streets. the masked gunman demanding money from the clerk and then he took off on foot. san ralph fall police are asking anyone with information to call the police immediately. there is a cash reward for information leading to an arrest. lock your windows and your doors. the warning after new numbers show a big jump in burglaries. christy smith joins us live with more on these numbers and the new map showing the exact areas being targeted. christy, good morning. >> reporter: good morning. i just spoke with one man this morning who says really this shouldn't come as a surprise.

the economy is is improving in some areas but people are still desperate so why not come to a place like palo alto? numbers are startling. that home burglaries are up 50% from last year. the trend is a five-year high according to a new crime report from the palo alto police department. police are say more homes are empty during the day. that could be one factor. sometimes the window is smashed or pried open but most often what happened is the doors or windows are just left unlocked. we took a look around recently and saw quite a few windows wide open. police reminding people to lock u. now, i just spoke with that man who told me it's easy to think it won't happen to me. >> people get in certain areas, are in a false sense of security. they think they're safe. they don't have to take precautions. especially in palo alto. they think palo alto is a safe city and don't realize that predators will come over here

too. >> reporter: a new crime map shows the hot spots for august and september. in the north, west and southeast of the city. in august, 26 burglaries, 5 already in september. police have increased patrols during the day but also at night they say when more car break-ins are happening as well. reporting live in palo alto, christy smith, today in the bay. >> new this morn, morning, 15 people are looking for another place to stay after a fire. it happened on pacific avenue. firefighters rescuing one person from the flames about 1:00 this morning. then had to evacuate 14 others. it took a little less than an hour to knock down the fire. no one was hurt. the cause is still under investigation. >> it's 6:08. a little bit of deja vu in the weather compared to yesterday. cool start, hot afternoon. >> yeah, repeat performance. then things really change

tomorrow. you might just be happy with the upper 80s as opposed to the near triple digit heat. strong on-shore flow this morning bringing on that cloud cover. let's get right to your wind speeds this morning. san jose just mostly clear conditions. mostly cloudy even over san jose. wind speeds are coming out of the west. you'll notice that here. you get that cool ocean air transported to your inland valleys. the air outside reaches 89 degrees. you're still going to feel that comfortable sea breeze. making it really nice out there. at noon today that breeze picks up. started to get 10 miles per hour sustained speeds. that's enough to keep you cool. open up those windows in your home. good air quality today. 68 at the coast. full forecast and seven day in a few moments. >> the tol plaza starting to show some backup in the cash lanes. typical pattern.

make a big announcement. rumor has it apple will be introducing the iphone 5. a man who claims he was abused by a priest as a child will meet with prosecutors today. william lynch claiming father jerold lindner lied on the stand when he told a jury he did not sexually assault lynch. lynch was acquitted beating the priest two years ago despite admitting he did it. >> the u.s. ambassador to libya has been killed in a rocket attack in ben ghazi. christopher stevens grew up in nowhere california. he graduated from cal berkeley in san francisco. new video from japan where nearly 10,000 people have been evacuated due to massive flooding. heavy rains burst the banks of a

river in the northern part of that country. flooding critical roadways and railways. rescue workers are using boats trying to move the people to safety. some very good news as firefighters battle to contain a big wildfire in northern california. the scolds fire is burning east of ukai. it has scorched 4600 acres. crews say they have it 70% contained. hundreds of people were evacuated over the weekend. that evacuate order has now been lifted. it is a much different story in washington. this new video shot overnight showing a series of firing burning over the cascade mountain range. it looks like the sky is on fire. hundreds of people have been evacuatel evacuated. three homes have been destroyed. more than 60,000 eracres. christina loren is here to

talk about the weather. >> it is going to be nice. elevated fire danger tomorrow. tomorrow, we'll see those off shore wind, pick up. what happens is those winds pump from land to sea. they negate that marine influence. so that will be tomorrow. today, we're getting that marine influence starting with a live picture over san jose. batman live next week at the hp p pavilion. this is going to keep us cool told. temperatures in the low 80s. no 90s on that temperature map till tomorrow, and then we will see possibly triple digits. we've got a major heat wave just around the corner. visibility's really dropping off. in gilroy, you've got three quarters of a mile. we'll see visibilities lowered. the fog will get worse before it

>> we look to the bridge where up till three minutes ago i saw a motorcycle on the road. no lanes were blocked but that driver got back on and headed west. smooth drive over to the peninsula. look at all the company you have in the westbound direction. a smooth drive north, heading towards that bridge. or south into the south bay. the bay shore freeway looks really nice. we'll catch up with these folks. some them in the south bay. coming down through mountain view and sunnyville. the commute direction is your northbound direction. so we'll check that. northbound from about capital expressway, and then really slamming down on the speeds. 680 to 880. continuing out to the airport for that build. we'll see 87 follow shortly in suit as well as 280 coming down. parallel to many spots. as a great alternate to you. east bay, smooth drive. freemont north past the scales

welcome back. live pictures from cairo, egypt, right now, where there has been some uproar. this is in relation to what's happening in libya where christopher stevens was killed overnight. we can tell you in cairo there are fears more of that will be spilling over. some of the devastation and attacks. secretary of state hillary clinton is there. she and president obama will be talking about the situation, hoping to put it in perspective. they will step to the mic later this morning to talk about the situation. we will keep you posted as more information comes in. >> 6:24. diamond jubilee is heading east today. >> that's right. prince william and his wife continue that tour of singapore

live from wall street, they are calling it apple day there. as traders gear up for a big-time announcement from the silicon valley tech titan. >> good morning. the anticipation is building over this morning's apple announcements. rumor has it the company will unveil its newest iphone. sources of the company's arch rival say they might sue to stop the sale of any new phone the moment it is introduced. our business and tech reporter scott mcgrew is live in san francisco where apple's announcement will be made. what would it take for samsung to sue? >> reporter: it would take $350, that's the filing fee in san jose federal court to sue someone and that's what it appears that samsung is threatening in that korean

newspaper article. at issue is apple's plan to unveil a lge capable phone. samsung and another company both own patents on this. samsung threatening to sue. the courthouse opens at 9:00 a.m. we expect the announcement at 10:00 a.m. i certainly contacted samsung and they wisely didn't answer. as for wall street, perhaps a bit of a sell-off. we often see that selling on the news. we'll continue to update you throughout the day. we'll have a big wrap up at 5:00. >> you're certainly not alone. a big story. >> reporter: there must be 12 out here and lots of excitement. >> all right, thanks.

we'll have continuing coverage of the apple announcement with scott mcgrew. and all day on our website nbc bay area.com. new this morning, an east bay man clinging to life as police try to track who shot him. police say in oakland the man is now in critical condition after being shot late last night at the intersection of west mack arthur boulevard and shafter avenue. so far, police have no description of the suspect. >> some troubling numbers. should have everyone in palo alto checking their windows and doors. police say burr glares are up. authorities say in some cases one simple change could have prevented this crime. live in palo alto with more on the numbers. >> reporter: good morning. police here in palo alto are

aware of what's going on. neighborhood groups have been trying to meet with police. some talking about surveillance systems. making sure that neighbors watch out for neighbors. residenti residenti residential burglaries are up. police are saying more homes are empty during the day, as kids are going back to school. sometimes the window is smashed or pried open. most often the doors or windows are left unlocked. we saw quite a few windows wide open. police reminding people of course to lock up those doors and windows. and locking up cars too because break-ins are also on the rise. >> never have anything showing on my car. on top of that, i have an alarm system and i use a club. and that way, it's a deterrent.

>> reporter: a new crime map that was released shows the hot spots for august and september are in the northwest and southeast parts of the city. in auction 26bu burglaries. in august, 26 burglaries. police have upped their patrols. new detail also as we get our first look at newly released surveillance video. the video shows a vapor cloud released moments before last month's massive chevron refinery fire in richmond. board members releasing that video during a meeting with the council last night. investigators say they're still try to determine exactly what that cloud consisted of. and that answer could really be extremely critical because at least 18 of the refinery employees were exposed to the cloud. investigators also telling the council parts the failed steel

pipe had gotten so bad it thinned to the thickness of a penny. officials are trying to determine why chevron did not inspect that pipe. today's the day. a really good looking day because of this fog this morning. good morning. you'll notice old glory blowing in the breeze. we've got that fog. the fog will be at its worst at 8:00. so cool enough for a jacket. we'll see temperatures jump from the 50s into the 60s by 8:00 a.m. we'll be left with a full deck of clouds at that point. from san jose, over the san francisco bay. and san francisco, mostly cloudy, till about noon.

it is day three of the chicago school strike. still no end in sight. negotiators are still talking. they say they're making some progress. both sides admit a deal still does not look imminent. at issue, pay, job security and teacher evaluations. total of about 25,000 teachers walked off the job monday, filling the streets to picket, affecting nearly 400,000 students. >> california republican congressional candidate is now backing away from a recent remark in which he said women who have abortions are more likely to get cancer. he made the statement during a debate earlier this week. the american cancer society

responded quickly. saying there's no scientific evidence to back those claims. yesterday, he retracted the comments saying he was misinformed. he is running for congress. >> we know a county supervisor will not face criminal charges in connection with a street fight. he was arrested on labor day after a fight with at least two other men. san diego's district attorney could still decide to file misdemeanor charges. a final decision will be made sometime this week. bay area blood shed in the streets of libya as a cal graduate loses his life during violent protests. an apple's annual hype fest more like a snooze fest?

happening now, the death toll is rising after a factory fire. in the country's two biggest city's yesterday. investigators saying many of those who died suffocated from smoke inhalation. they also say the buildings did not have fire exits and several doors that were leading to the outside were locked. also new this morning, some new video out of syria. we have amateur video showing an intense firefight between rebel forces and the syrian government. this one took place at aleppo

film they deemed blasphemous to the prophet muhammad. within the past 20 minutes, the law school in san francisco released a statement on the killing say, quote, the ambassador was performing the highest role that a lawyer is called upon to perform and that is public service. president obama also releasing a statement, condemning the attack, also calling the ambassador an exemplary representative of the united states. saying, brave americans we lost represent the extraordinary sacrifice and sacrifices that our civilians make every day around the globe. the president will speak more about the killings in a live address at 7:35 this morning. you can watch that address right here on nbc bay area. also from the white house, the people there saying it was not intentional but israeli officials are saying president obama snubbed prime minister netanyahu. an israeli official says

netanyahu asked for a meeting with president obama after the opening of the u.n. general assembly last month. netanyahu even offered to travel to washington for the meeting but he was told the president was just too busy. white house says the president cannot meet the prime minister because he won't be in new york at the same time and claims netanyahu did not request a meeting in washington. moving on to decision 2012. the presidential campaign is in full swing again today after a break to observe the september 11th memorials. president obama heading to nevada today. a state mitt romney visited yesterday. the presidential candidates and their surrogates will also be in florida, colorado today, all battleground states. with polls so tight, this election may hinge on turnout. clinton is stumping for the president in florida today. he's going after the youth vote,

the case will be meeting with prosecutors to talk about charging that priest with perjury. goodmorning. >> good morning. the d.a. wants to meet with william lynch before deciding whether he will file perjury charges against father jerry lindner to face those perjury charges. during the trial of william lynch just a few months ago here in san jose, the father took the stand and said he never abused lynch or his brother. lynch was on trial for beating up the priest two years ago in retaliation for that alleged abuse. when the priest denied the abuse, lynch's lawyer jumped out of his chair and told the judge to get him a lawyer because he had just perjured himself. now, it's the priest who might be on trial facing those perjure charges. link's lawyer pat harris accused the prosecutor of setting up lindner to perjure himself.

something the d.a.'s office denied. lindner waits at his retirement home to see what the d.a.'s decision will be. we're live in san jose. today in the bay. >> thank you, damien. another south bay man is coming forward in a separate case of sexual abuse. this time at a san jose prep school. the alleged victim says jesuit brother william farrington abused him when he was a boarding student back in the '60s. the accusation is not the first. the california society of jesuits which overseas bellarmine sent a letter which reads, william farrington was removed from ministry with minors after allegations surfaced. he now exercises no public ministry and lives under close supervision at the jesuit infirmary. his restrictions are reviewed annually. the victim says he wanted to put his story out there as part of the healing process and encouraging other possible victims to seek healing of there

their own. now, the final heroic act of a fallen police officer. 37-year-old kennan yunstrum shot and killed last week. the officer was an organize be donor. his right kidney went to a 52-year-old bay area woman. who had been waiting for a transplant for ten years. a 29-year-old bay area removed his left kidney and pancreas. a 63-year-old bay area woman received his liver and a father of four in southern california was the recipient of his heart. now, the official memorial for the officer will be held at the mission church in bacaville. that will take place tomorrow morning. we're also learning more about the man detectives say shot the officer. detectives searched the county home of 36-year-old christopher lacey. they seized a handgun safety certificate, a gun carrying case

and three shooting targets. we've also learned the software engineer had been hired by a mountainview company through the recruiting agency minesource. lacey was shot to death by yunstrom's partner just moments after police say lacey shot officer yunstrom. a preliminary hearing continues for an oakland teenager who admits to killing his adoptive parents. a dramatic video played yesterday. it shows moses canen admitting he killed his adoptive parents in a fit of anger after he was suspended from school for smoking marijuana. he was 15 at the time. he's 16 now. the teen is being prosecuted as an adult. on two counts of murder. his adoptive parents were found dead in a parked car outside their oakland home in january. 6:55 now. troubling numbers should have everybody in palo alto checking their windows and doors. police say burglaries are way up there to their highest point in five years.

authorities add some cases just one simple change could have prevented the crime. christy smith is live in palo alto. she has more on what police are asking everybody to do. christy, good morning. >> reporter: neighbors here in palo alto have told police they're concerned there are more forced entries going on. most of the time they're getting in easily, going right through an open door or window. new statistics show most of the burglaries are happening in the northwest and northeast part of the city. 26 burglaries in august. 5 so far in september. a jump of 50% over last year. we drove around recently and found people still leaving those windows open. police reminding people to lock them up. there's increasing patrols in the day when these burglaries are most likely to occur. some homeowners say they're considering getting video monitoring systems at
